[293] 1 Mary the widdow & Relict of William Hodges, shew by Peticon that the Estate of Walter Wharton deceased is debtor unto hur the sume of one hundred gilders & that the siad walter wharton upon his death bed had sesiered that shee the peticoner might bee one of the first sattisfyed, and therefore desiering that shee might have an order against the said Estate for the payment of the said sume of 100 gilders, one of the first according to the desire of the said deceased.
The Court haveing Examined the premises doe grant the Peticoner hur Request. (Records of the court of New Castle, 1:309)
The subsequently-filed accounting of the estate of Walter Wharton shows that 100 gilders had been paid to "the widdow hodges." (Records of the court of New Castle, 1:382, 478)
On November 3, 1680, the New Castle Court heard the case of Mary Hedges v.
Annettie Ollesdotter in a case of slander. The court minutes, as transcribed
(with pertinent details omitted by the transcriber) state:
MARY HODGES, Plaintiff ANNETTIE OELAS, Defendant} In an action of slander & defamation
The Plaintiff declares that this defendant hath slaundered hur in a high
nature by falsly saying & divulging that this Plaintiff had Layne with on Jan
Cornelis (John Corneliusson)... The defendant Denyes itt & sayes to have sayed noe otherwayes but that John Cornelis had tould her that the Plaintiff had.... The Case being heard & wittnesses Esamined, The Court ordered that the defendant shall make publicq aknowledgment in Court that shee has falsly
defamed the plaintiff & pay the Costs. The defendant in Court made publicq
aknowledgment as above. (Records of the court of New Castle, 1:434-435; note
the two ommissions in the transcription).
At the New Castle Court held January 5, 1680/1, the following report was
entered:
Upon the Peticon preferred in behalfe of Mary the widdow of Will: hodges,
The Court does Grant hur to take up a Lott within this Towne of new Castle; on the west syde next to the Lotts Granted unto Jan Biscus & Isacq Tayne provyded she forthwith builds theron according to Lawe & Regulacons. (Records of the court of New Castle, 1:448)
The survey, made by Ephraim Herman, as subsequently recorded (Records of the court of New Castle, 1:512) stated:
By virtue of an order from the Court of New Castle Laid out for Mary hodges a Lott of Land Lying and being within this Towne of new Castle haveing to the west the harte Street to the north the Brewer Street to the East a vacant peece of Land nott as haveing any perticular owner and to the South a steet now Called St. Maries Street, Containing in breath sixy foott and in lenght one hundred and sixty foott. Surveyed the 8th of Jannuary Annoqs. Dom: 1680/81 per EPH: HERMAN, Surveyor
